• www.organikgiller.comİnternet ortamında alışveriş yapan, sipariş veren ve bu sözleşmeyi onaylayan kişi. (Bundan sonra "Alıcı" olarak anılacaktır. Alıcının adı, soyadı, adresi ve iletişim bilgileri sipariş sırasında girilen bilgilerdir.)

2. SÖZLEŞMENİN KONUSU

İşbu Sözleşme'nin konusu, Alıcı'nın, Satıcı'ya aitwww.organikgiller.comİnternet bağlantısının elektronik kullanımı siparişini, aşağıda özellikleri ve satış fiyatı belirtilen ürün/hizmetlerin satışı ve teslimi ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği kayıtların tutulmasının hak ve bunların belirlenmesidir.

3. SÖZLEŞME KONUSU ÜRÜN, BEDEL VE ​​ÖDEME

Alıcı tarafından sipariş edilen kalitesiz miktar, satış bedeli, ödeme şekli ve teslimat bilgileri siparişin sonlandığı andaki gibidir ve Alıcının e-posta yoluyla gönderilen fatura/sipariş özeti ile sabittir. Kargo/Nakliye ücreti Alıcı tarafından karşılanacak olup (aksi bir kampanya belirtilmediyse) sipariş toplamına dahil edilir.

4. GENEL HÜKÜMLER

• 4.1. Alıcı,www.organikgiller.comİnternet sitesindeki sözleşme konusu ürünün temel özellikleri, satış fiyatı ve ödeme şekli ile teslimata ilişkin ön bilgilendirmenin yapıldığı bilgi sahibi olup olmadığı ve elektronik açıdan gerekli teyidi incelenir kabul eder.

• 4.2. Sözleşme konusu ürün, Alıcının yerleşim yerinin uzaklığına bağlı olarak yasal 30 günlük süreyi aşmamak, dosyalama ile internet sitesindeki ön bilgiler içinde tutulan süre içinde Alıcı veya gösterdiği adresteki kişi/kuruluşa teslim edilir. Ancak organik, taze sebze ve meyve gibi çabuk bozulabilen, bozulmayacak nitelikte olup, Satıcı teslimat süresi en kısa sürede (mümkünse ertesi gün veya kaydedilen teslimattan elde edilir) gerçekleştirmeyi hedefler.

• 4.3. Sözleşme konusu ürün, Alıcı'dan başka bir kişi/kuruluşa teslim edilecek ise, teslim edilecek kişi/kuruluşun teslimatı kabul edilmemesinden Satıcı sorumlu tutulamaz.

• 4.4. Satıcı, sözleşme konusu ürün sağlam, eksiksiz, siparişte belirtilen niteliklere uygun olarak teslim edilmesinden sorumludur.

• 4.5. Organik ve taze gıda dağıtımları teslimatı sırasında Alıcının adresinde bulunmaması ve/veya teslim alacağının olmaması durumunda bozulma, patlama gibi zararlardan ve gecikmelerden Satıcı sorumlu değildir.

5. ÇAYMA HAKKI VE İSTİSNALARI

27 Kasım 2014 tarihli Resmi Gazete'de yayımlanan Mesafeli Sözleşmeler Yönetmeliği'nin "Cayma Hakkının İstisnaları" başlıklı 15. maddesinin (c) bendine göre; "Çabuk bozulabilen veya son kullanma tarihini geçme olasılığı olan malların teslimine ilişkin sözleşmelerde cayma parasını kullanamaz."

• 5.1. www.organikgiller.comürününde satışı yapılan taze sebze, meyve ve diğer çabuk bozulabilir/taze gıda maddeleri kapsamın da bulunur, Alıcının bu ürünlerinde "sebepsiz yere cayma ve ürünü iade etme hakkı" yoktur.

• 5.2. Ancak, teslim edilen kalitesiz ayıplı (çürük, ezik, ambalajı patlamış, taahhüt edilen organik sertifikaya uymayan vb.) olması durumunda, Alıcı ürününün teslim edildiği gün (ürünün eksiksiz olması şartıyla) durumu fotoğraflayarak Satıcı'nın iletişim talimatlarına (e-posta veya WhatsApp) bildirle sağlanır. Bu durumda Satıcı, ürün bedelini iade eder veya yeni ürünü ücretsiz olarak gönderir.

• 5.3. Çabuk bozulabilir gıda maddesi kapsamına girilmeyen, dayanıklı ambalajlı/kuru organik gıda bozulmada (örnek kavanozlu, paketli bakliyat vb.) Alıcı, teslim tarihinden itibaren 14 gün içinde hiçbir gerekçe göstermeksizin cayma hakkına sahiptir. Bu durumda ambalajın açılmamış, bozulmamış ve ürünün tekrar satılabilir nitelikte olması sağlanır.

6. UYUŞMAZLIKLARIN ÇÖZÜMÜ

İşbu Sözleşmenin ödemesinde, Tüketici Hakları mevzuatı çerçevesinde ilan edilen yasal parasal biriktirmeye göre Alıcının mal veya hizmet satın aldığı ve ikametgahının bulunduğu yerdeki Tüketici Hakem Heyetleri ile Tüketici Mahkemeleri yetkilidir.

7. YÜRÜRLÜK

Alıcı,www.organikgiller.comsitesi üzerinden sipariş verildiğinde ve ödemeyi gerçekleştirdiğinde işbu sözleşmenin tüm parçalarını kabul etmiş sayılır.

1. PARTIES

1.2. BUYER (CONSUMER):

The person who makes a purchase, places an order, and approves this agreement via www.organikgiller.com. (Hereinafter referred to as "Buyer". The Buyer's name, surname, address and contact information are the information entered during the order.)

2. SUBJECT OF THE AGREEMENT
The subject of this Agreement is the Buyer's order for the electronic use of the Seller's website www.organikgiller.com, the sale and delivery of the products/services specified below with their characteristics and sales price, in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, and the keeping of records and determination of these rights.

3. SUBJECT OF THE AGREEMENT: PRODUCT, PRICE AND PAYMENT
The quantity, sales price, payment method and delivery information ordered by the Buyer are as they are at the time the order is finalized and are fixed with the invoice/order summary sent to the Buyer via e-mail. Shipping/delivery costs will be borne by the Buyer (unless a campaign is specified otherwise) and will be included in the order total.

4. GENERAL PROVISIONS
4.1. The Buyer acknowledges and accepts that they are aware of the basic characteristics of the product, the sales price, the payment method, and preliminary information regarding delivery provided on the website www.organikgiller.com, and that they have received the necessary electronic confirmation.

4.2. The product subject to the contract will be delivered to the Buyer or the person/organization at the address indicated by the Buyer within the legal period of 30 days, not exceeding the time frame specified in the preliminary information on the website and in the filing, depending on the distance of the Buyer's place of residence. However, for perishable or non-perishable organic, fresh vegetables and fruits, the Seller aims to deliver as soon as possible (preferably the next day or as recorded in the delivery receipt).

4.3. If the product subject to the contract is to be delivered to a person/organization other than the Buyer, the Seller cannot be held responsible if the recipient refuses delivery.

4.4. The Seller is responsible for delivering the product subject to the contract in good condition, complete, and in accordance with the specifications stated in the order.

4.5. The Seller is not responsible for damages such as spoilage, explosion, and delays in the event that the Buyer is not present at the address and/or there is no recipient for delivery of organic and fresh food products.

5. RIGHT OF WITHDRAWAL AND EXCEPTIONS
According to Article 15(c) of the Regulation on Distance Contracts published in the Official Gazette dated November 27, 2014, titled "Exceptions to the Right of Withdrawal"; "The right of withdrawal cannot be used in contracts relating to the delivery of goods that are perishable or likely to exceed their expiration date."

5.1. The fresh vegetables, fruits, and other perishable/fresh food products sold on www.organikgiller.com are included in this scope. The Buyer does not have the "right to withdraw and return the product without reason" for these products.

5.2. However, if the delivered product is defective or of poor quality (rotten, crushed, damaged packaging, not complying with the promised organic certification, etc.), the Buyer must photograph the situation on the day of delivery (provided the product is complete) and notify the Seller via email or WhatsApp. In this case, the Seller will refund the product price or send a new product free of charge.

5.3. For perishable food items, such as organic food in durable packaging/dry food (e.g., jarred or packaged legumes, etc.), the Buyer has the right to withdraw from the contract within 14 days of the delivery date without giving any reason. In this case, the packaging must be unopened, undamaged, and the product must be in a resalable condition.

6. RESOLUTION OF DISPUTES
For payment under this Agreement, the Consumer Arbitration Boards and Consumer Courts in the place where the Buyer purchased the goods or services and where they reside, are authorized according to the legal monetary accumulation criteria announced within the framework of Consumer Rights legislation. 7. EFFECTIVE DATE
The Buyer is deemed to have accepted all parts of this agreement when placing an order and making payment through the www.organikgiller.com website.

GİZLİLİK VE KİŞİSEL VERİLERİN KORUNMASI SÖZLEŞMESİ (POLİTİKASI)

1. VERİ SORUMLUSU

www.organikgiller.cominternet sitesi üzerinden kişisel verilerin korunmasız, 6698 sayılı Kişisel Verilerin Korunması Kanunu (KVKK) saklanabilen "Veri Sorumlusu" kimliğiyle, Brandium Residence, Küçükbakkalköy Mh. Dereboyu Cd. No:3/AR Blok K:7 D:48 Ataşehir / İstanbul konumunda mukim Tüğmen Hayvancılık ve Tarım San. ve Tic. Ltd. Şti. tarafından aşağıda yetenekleri işlenmektedir.

Kişisel haklarınız yok; siparişinizin boyuta ulaştırılabilmesi amacıyla kargo şirketleri, faturalandırma için mali müşavirlik/muhasebe sistemleriyle, ödemenizin güvenli bir şekilde alınabilmesi için ilgili banka/ödeme dağıtım altyapılarıyla ve yasal olarak yönetilen yetkili kamu kurum ve dağıtımları ile paylaşılmaktadır. Bunun dışında kalanlar asla üçüncü kişilere satılmaz veya ticari amaçla devredilmez.

5. KULLANICI HAKLARI (KVKK MADDE 11)

Dilediğiniz zaman info@organikgiller.com adresindeki dağıtımlarda veya şirketimize yazılı başvuruda bulunarak kişisel ayarların;

• İşlenip işlenmediğini öğrenme, işlenmişse bilgi talep etme,

• İşlenme amacını ve amacına uygun kullanılıp kullanılmadığını öğrenme,

• Eksik veya yanlış işlemlerse yapıları istememe,

• Kanuni şartlarının silinmesini veya yokluklarını isteme hakkı kazanır.

6. ÇEREZLER VE GÜVENLİK

Sitemiz, kullanıcı deneyimini artırmak ve alışveriş sepetinizi hatırlamak amacıyla çerezler (çerezler) ortaya çıktı. 7. YÜRÜRLÜK

www.organikgiller.comsistemi kullanan, kullanıcı olan veya alışveriş yapan kullanıcı, bu Gizlilik sözleşmesinde yer alan tüm şartları okumuş ve kabul etmiş sayılır.
